Should Verstappen receive a penalty for this overtaking action?

This morning it was announced that Max Verstappen has to go to the stewards because of overtaking during the red flag in the second free practice. The Dutchman was on a fast lap and was about to overtake Lance Stroll, when the red flag was waved due to Lewis Hamilton stopping. So the FIA sees a possible penalty in it, but judge for yourself. In the video you can clearly see that Verstappen only sees the red flag when he has already passed Stroll, while he already left the throttle.
